Terms of Use

This page sets out the terms and conditions ("Terms of Use") governing access to and use of the GrowMint platform by any registered user or individual ("User", "You", "Your"). These Terms apply to your access to, browsing of, or use of:

• The GrowMint mobile application and/or website (collectively, the "Platform")
• Your GrowMint user account ("Account")
• Services provided by GrowMint ("Services")

GrowMint is a product owned and operated by ANV Fintech Private Limited, a company incorporated under the Companies Act, 2013 ("Company", "We", "Our", "Us"). GrowMint is a technology product of the Company and does not constitute a separate legal entity.

1. Modification of Terms

GrowMint reserves the right to modify or update these Terms of Use at any time without prior notice. Changes shall be effective immediately upon posting on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Platform Services

GrowMint provides a digital wealth monitoring and information platform. GrowMint is not registered with the Securities and Exchange Board of India (SEBI) and does not provide any investment advisory, portfolio management, or execution services. The Services may include:

• Aggregation and display of financial information relating to bank accounts, mutual funds, equities, ETFs, and other financial instruments through RBI-licensed Account Aggregators, including Finvu Account Aggregator
• Portfolio tracking, analytics, and insights
• Facilitation of non-financial services such as data refresh, account linking, and information updates
• Responding to user queries and providing customer support
• Any other services incidental or ancillary to the above

3. Compliance with Law

You agree that:

• All information provided by you is true, accurate, current, and complete
• You authorize GrowMint to verify and validate information provided by you
• Funds reflected in linked accounts originate from legitimate sources
• You are a resident of India and access the Platform in compliance with applicable Indian laws
• You are competent to enter into a legally binding contract under the Indian Contract Act, 1872

GrowMint will perform its obligations in accordance with applicable laws, including RBI Account Aggregator guidelines and data protection requirements.

4. Registration and Eligibility

To use the Services, you must register on the Platform by linking your mobile number and completing the onboarding process.

Eligibility requirements:

• Only Indian residents who are individuals capable of entering into a valid contract are eligible
• GrowMint relies on the information provided by you for eligibility verification and bears no liability for incorrect or fraudulent information

5. Account Security and Login Credentials

Your access to the Platform is protected through login credentials including passwords, OTPs, or other authentication mechanisms ("Login Credentials").

You agree that:

• You are solely responsible for maintaining confidentiality of your Login Credentials
• GrowMint is not liable for unauthorized access resulting from your failure to safeguard credentials
• You will immediately notify GrowMint of any unauthorized access, security breach, or loss of device

All actions performed using your Login Credentials shall be deemed to be authorized by you.

6. Risks and Disclaimers

• Any information, analytics, charts, or insights displayed on the Platform are for informational purposes only
• Past performance is not indicative of future results
• GrowMint displays financial data strictly as received from third-party sources and Account Aggregators and does not guarantee the accuracy, completeness, timeliness, or correctness of such data
• Services are provided on an "as-is" and "as-available" basis

7. Access to Third-Party Accounts

By using the Platform, you authorize GrowMint to access your financial information from third-party platforms via RBI-licensed Account Aggregators, including Finvu, solely for the purpose of providing Services. Your use of such services is also subject to Finvu's terms and conditions.

Such authorization is:

• Explicit and consent-based
• Time-bound and revocable
• Governed by the RBI Account Aggregator framework

GrowMint does not control third-party platforms and is not responsible for their availability or accuracy.

8. Internal Use of Information

You authorize GrowMint to use and share your information within the GrowMint Group strictly for providing Services, complying with legal obligations, and improving the Platform, subject to the Privacy Policy.

9. Customer Communications

By accepting these Terms, you consent to be contacted by GrowMint and its service providers via calls, SMS, emails, WhatsApp, in-app notifications, or automated systems for service-related communications.

You confirm that the contact details provided belong to you and agree to keep them updated.

10. Third-Party Service Providers

GrowMint may engage third-party service providers for KYC, analytics, cloud hosting, Account Aggregator integration, notifications, and other operational purposes.

These providers operate under their own terms and privacy policies. GrowMint does not control or assume liability for third-party platforms.

11. Intellectual Property Rights

All content on the Platform, including text, graphics, logos, software, and reports, is the intellectual property of ANV Fintech Private Limited or its licensors.

You may use the Platform solely for personal, non-commercial purposes. Unauthorized reproduction, distribution, or exploitation is prohibited.

12. Indemnity

You agree to indemnify and hold harmless GrowMint, its directors, employees, and affiliates from any losses, claims, or expenses arising out of:

• Your breach of these Terms or the Privacy Policy
• Fraud, misrepresentation, or unlawful use of the Platform

13. Limitation of Liability

To the maximum extent permitted by law:

• GrowMint shall not be liable for any indirect, incidental, or consequential losses
• GrowMint does not guarantee uninterrupted or error-free access to the Platform
• GrowMint is not responsible for market losses, data inaccuracies, or third-party delays

14. Arbitration

Any dispute arising out of or relating to these Terms shall be referred to arbitration by a sole arbitrator appointed by GrowMint.

The arbitral award shall be final and binding.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Courts at Mumbai shall have exclusive jurisdiction.

16. Termination

You may request deletion of your Account through the Platform. GrowMint may suspend or terminate your Account for non-compliance with these Terms or applicable laws.

Certain data may be retained post-termination to meet legal or regulatory obligations.

17. Force Majeure

GrowMint shall not be liable for failure or delay in performance due to events beyond its reasonable control, including natural disasters, system failures, cyber incidents, or government actions.

• Notices will be communicated via registered email or in-app notifications
• Rights under these Terms may not be assigned by you without prior written consent
